Lifer for five in murder case

ADDITIONAL Sessions Judge A V Dixit on Saturday sentenced five persons to life imprisonment in the sensational Rupesh Kale murder case.

The court convicted Sandesh alias Golu Venu Naik, a resident of HUDCO Colony, Kamesh Ravindra Jambhulkar, a resident of Kausalyayan Nagar; Aakash alias Bittu Jaikumar Sarojkar, Kunal Bharat Goswami and Shekhar Prakash Ambulkar, all residents of Indira Nagar slums, as the charges under Sections 302 and 34 of the Indian Penal Code (IPC) were substantiated against them. The court acquitted Rajesh Haritswamy Anthony, a resident of Martin Nagar, and Shailesh Vijay Mukherjee, a resident of Kausalyayan Nagar, as the charges could not be proved against them.

A resident of HUDCO Colony, Jaripatka, Rupesh alias Pappu Janardan Kale (25) and Kunal Goswami used to commit thefts. A dispute arose between them. Rupesh started social service in the locality. Considering his social activities, Bhim Sena inducted him as an office-bearer. Kunal was angry as Rupesh started establishing his supremacy in the area. He had also threatened to kill Kunal. As a result, Kunal decided to teach Rupesh a lesson. Kunal and his accomplices stormed into Rupesh’s house to eliminate him. But, Rupesh was not in the house. On January 14, 2014, Rupesh had organised a ‘Kheer Korma’ programme. Residents of the locality attended the programme. After the programme, Rupesh, his friends Shimon Thorat, Abhay Landge and Sultan were at the venue. Around 8 pm, Sandesh and his accomplices came. They threw chilli powder in Rupesh’s eyes and attacked him. Sandesh attacked Rupesh with a sword causing injuries on his neck.

However, Rupesh tried to run away but collapsed. Abhinay Ganvir and Praveen Bobhate rushed a profusely bleeding Rupesh to Mayo Hospital where he succumbed to his injuries on January 16, 2014. On January 20, 2014, Jaripatka Police arrested the accused on charges under Sections 302, 143, 147,148 and 326 of the IPC.
The then Police Sub-Inspector Sanjay Naik investigated the case and filed a chargesheet against the accused. The court examined a total of 15 witnesses, including mother of the deceased.

As the charges were proved against Sandesh, Kamesh, Aakash, Kunal and Shekhar, the court sentenced them to life imprisonment with a fine of Rs 3500 each
Additional Public Prosecutor Vasant Narsapurkar represented the State. Adv Chetan Thakur, Adv Lubesh Meshram, Adv Mirza, Adv A Gharde and Adv Mir Nagman Ali were the defence counsels.
