HC demands action plan in helmet case

In the matter related to two-wheeler riders not wearing helmets, the division bench of the Madhya Pradesh High Court comprising Chief Justice, Hemant Gupta and Justice, Rajeev Kumar Dubey has directed the counsel for the State to give an action plan to ensure compliance of traffic rules.


The division bench has heard the petitions filed by Dr A K Bajpai and others. Earlier, Government Advocate for the respondents/State had submitted that subsequent steps were taken by them and compliance report was filed by them on January 31, 2017. Copy of the same be supplied to the counsel for the petitioner. List the petition by placing the same on record. The respondents may also file report, indicating the subsequent steps taken by them towards compliance of the provisions of law and the directions issued by this court.


In the hearing on January 3, 2017, Action Taken Report was filed by the State Government. Let a copy of the same be supplied to the counsel for the petitioner.


Earlier, the division bench had said in the order that the Secretary, Home Department, shall explain why the law as amended in the year 2005 has not been enforced in its letter and spirit across the State so far. Merely convening meeting in the year 2007 without any follow-up action taken thereafter, to say the least, is a case of casual approach in respect of such a serious issue dealing with the health and safety of the travellers driving two-wheelers and also the pedestrians.


The division bench had added that we hope that the Secretary, Home, will immediately move into action and issue appropriate directions to all concerned to fulfill the statutory obligations and to ensure that the amendment of 2005 is complied with by all the duty-holders in its letter and spirit.
