HC takes stern stand against polythene

Chhattisgarh High Court has ordered for strict implementation of the Notifications to ban PVC products and plastic carry bags in the state while hearing public interest litigation (PIL) on Friday. It’s to be noted that on the order of the High Court, State Government had issued a Notification, dated September 27 2017, to ban on the manufacturing, selling, transportation and usage of items made of polyvinyl chloride (PVC).

Earlier, on January 1, 2015, a similar ban was imposed on the polythene carry bags on the PIL of environmentalist Nitin Singhvi. When the Raipur Municipal Corporation (RMC) and Environment Conservation Board started releasing persons in violation of the notifications for meagre penalty, High Court had summoned the Urban Administration and Development Department Special Secretary to show up at the Court.

Special Secretary had submitted an Affidavit and informed about actions taken against 905 persons in 13 days across the state. Later, through another Notification, ban on PVC products such as flex, hoardings and food packets. As per Notifications, things that are banned include plastic carry bags with handle or no handle as defined by Environment Conservation Board. Items used in packaging of food: As per Notification, plastic means as defined in the Plastic Waste Management Rules 2016, which include High Density Polythene (HDP), Low Density Polythene (LDP), and 7 other different types of polymer made items. 

HDP and LDP are used to manufacture plastic cups, plates, bowl, spoon and other such items in Chhattisgarh. Advertisement banner flex means short-life PVC and chlorinated plastic, advertisement and publicity materials. Violation of the Notification can fetch the accused a penalty of Rs 1 lakhs or imprisonment from 3 years to 7 years or both.
