A Sanskrit teacher in Rewa district challenged the order of District Education Office in which she was declared surplus in the scheme of rationalisation. The single bench of the Madhya Pradesh High Court comprising Justice, Vandana Kasrekar has directed the District Education Officer, Rewa to decide the objection submitted by the petitioner within a period of one month. Till the objection preferred by the petitioner is adjudicated, status-quo as it exists on today shall be maintained.


The single bench of the MPHC heard the petition filed by Vandana Singh. The petitioner has filed the present petition, challenging the order dated on October 4, 2017, by which she has been declared surplus. The petitioner is a Sanskrit teacher and she was declared surplus in the scheme of rationalisation.


Against the said list of rationalisation, the petitioner as well as another respondent filed their objections before the competent authority. The competent authority has allowed the objection. However, thereafter, inspite of allowing the objection, the respondent has issued a list dated on October 4, 2017, in which the petitioner has been declared as surplus and on the basis of said list, it is apprehended that she may be transferred to other place.


Counsel for the petitioner submitted that the petitioner has submitted her objection to the Collector as well as District Education Officer. It is, therefore, prayed that the writ petition be disposed of with a direction to the aforesaid authorities to consider and decide the objection within a stipulated time period. On the other hand, learned Government Advocate for the respondents submitted that suitable decision shall be taken in the matter in accordance with law.


In view of aforesaid submissions made by learned counsel for the parties, the writ petition was disposed off with the direction to the High Court of Madhya Pradesh that the respondent District Education Officer, Rewa to decide the objection submitted by the petitioner within a period of one month, single bench said. The petition filed by the petitioner Vandana Singh, Assistant Teacher (Sanskrit) against the Principal Secretary, Education Department, Bhopal, Commissioner, Public Instructions, Bhopal, District Education Officer, Rewa, Principal, Government Girls High School Raipur Karchuliyan, Rewa and Krishna Kol, Teacher. Advocate S P Mishra appeared on behalf of the petitioner, while Government Advocate Janvi Pandit for the State.
