HC issues notice to Returning Officer

IN THE matter related to by-election of 12th Shahdol Parliamentary Constituency, single bench of Madhya Pradesh High Court comprising Justice Atul Sreedharan issued notice to Returning Officer Ajay Mishra in the case. Single bench has listed this case on December 15, 2017, for evidence of respondent. During hearing, Satish Tiwari, Record Keeper of documents pertaining to by-election of 12th Shahdol Parliamentary Constituency, was present before the court. Records shall be kept in safe custody of the court till the decision of this case. As there is no further need of the Record Keeper, he is discharged. His presence is no longer required in the case. The petitioner has been examined and cross-examined. He is discharged. His presence is no longer required.

Original documents constituting exhibit have been seen by this court and compared with copy and found to be same and originals are returned to the petitioner. Upon payment of requisites, issue notice to Ajay Mishra, Returning Officer in this case. Single bench has listed the matter on December 15 for evidence of respondent, the single bench said. Single bench of MPHC heard the petition filed by Mahaveer Prasad Majhi against Member of Parliament, Shahdol Gyan Singh.

This petition has been filed by the petitioner challenging rejection of his nomination paper. In previous hearing of the case, single bench of MPHC had called the record relating to by-election of 12th Shahdol Constituency. Office note dated on November 3, 2017, reflects that summons to the officer concerned (record keeper) in custody of original record having been prepared and sent. Original record is awaited,under the circumstances, single bench said in previous hearing. Advocate Ankit Saxena appeared on behalf of the petitioner, while Advocate Aditiya Khandekar for the respondent.
