NMC to issue Occupancy Certificate within 8 days

Maharashtra Government has directed Municipal Corporations and Municipal Councils to issue building commencement certificate within 30 days and Occupation Certificate within 8 days. Recently, the High Court has directed power utilities not to supply electricity to any building without occupancy certificate from planning authority. Occupancy certificate denotes completion of building as per sanctioned plan, but developers find it difficult to get it from Planning Authority like NMC or NIT. As per information, during last 25 years, very few developers bothered to obtain occupancy certificate and most of high-rise buildings are occupied without a valid completion certificate and occupancy certificate.

The government has notified the revised time limits under sub-section (1) of section 3 of the Maharashtra Rights to Public Services Act -2015 for different services. The government has also appointed designated officers, first and second appellate Authorities for the public services. The plinth checking certificate will be provided within 7 days.

The decision will bring huge relief to people who are waiting for months to secure OC, Building Commencement Certificate and plinth Checking Certificate. The occupancy norms were finalised to ensure structural safety, adherence to sanctioned map, side margins and fire safety in case anything untoward happens. But neither the NMCs town planning department nor its fire safety wing ever bothered to check facts or initiated any action against the violators.

The government has decided to provide basic services in stipulated time to the citizens so that they are not required to run from pillar to post to obtain these certificates. This will also bring transparency in the system and hopefully remove the deep-rooted corruption.

It may be mentioned that Chief Minister Devendra Fadnavis has passed the Maharashtra Right to Public Service Act, 2015 to provide corruption free and transparent administration and time-bound delivery of defined services while making administrative machinery accountable by simplifying the procedure and bringing entire decision making process on digital platform.

The designated officer will be Assistant Town Planner, Assistant Engineer or Junior Engineer for services related to Town Planning Department. The First Appellate Authority will be Town Planner, Deputy Engineer and Second Appellate Authority will be Deputy Director, Assistant Director of Town Planning, City Engineer, Executive Engineer, and Chief Officer.

The tree felling permission will be given within 45 days. The designated officer for the permission is Junior Engineer while First Appellate Authorities Deputy Engineer and Second Appellate Authority will be Executive Engineer.
