HC directs CMHO of Anuppur to respond expeditiously over post of support staff

CHALLENGING the dispensed order from the services of the petitioner for the post of support staff for National Health Mission, the single bench of Madhya Pradesh High Court comprising Justice Vandana Kasrekar has directed the respondent Chief Medical and Health Officer of Anuppur to consider and decide the representation in the light of the order dated on November 8, 2016 passed by the respondent Mission Director of National Rural Health Mission, Bhopal as expeditiously as possible preferably within a period of one month.


Single bench has heard the petition filed by Ram Bai Mahra. The petitioner has filed the present petition challenging the order dated on September 1, 2016 passed by the respondent Chief Medical and Health Officer of Anuppur by which the services of the petitioner on the post of support staff, National Health Mission, Government of Madhya Pradesh has been dispensed with counsel for the petitioner submitted that the petitioner was working on the post of support staff.

She was appointed on January 29, 2014. The respondent Chief Medical and Health Officer of Anuppur has issued an impugned order by which the services of the petitioner has dispensed with. However, Mission Director National Health Mission has issued a letter dated on November 8, 2016 directing the Chief Medical and Health Officers that the services of support staff be continued.


It is submitted that inspite of the aforesaid order passed by the Mission Direction, the respondent Chief Medical and Health Officer of Anuppur has discontinued the services of the petitioner.

Therefore, with regard to her grievances, the petitioner has submitted a representation to the respondent Chief Medical, Health Officer of Anuppur and prays that the instant writ petition be disposed off with the direction to the respondent Chief Medical and Health Officer, Anuppur to consider and decide the said representation in the light of the order dated on November 8, 2016 must be passed by the respondent Mission Director of National Rural Health Mission Bhopal, expeditiously. On the other hand, learned counsel for the respondent Mission Director of National Rural Health Mission Bhopal fairly submitted that the representation submitted by the petitioner shall be dealt with expeditiously in accordance with law.


In view of aforesaid submissions made by counsel for the parties, the writ petition is disposed of with a direction to the respondent namely Chief Medical and Health Officer of Anuppur to consider and decide the representation in the light of the order dated on November 8, 2016 passed by the respondent Mission Director of National Rural Health Mission Bhopal as expeditiously as possible preferably within a period of one month, the single bench said.
