HC seeks reply from Jabalpur Collector, others

IN THE matter related to misuse of rules (Beyond the Rules) as a Member of Child Welfare Committee, Arun Jain and take advantages of his membership, division bench of Madhya Pradesh High Court comprising Chief Justice Hemant Gupta and Justice Vijay Kumar Shukla on Friday issued fresh notices on non-compliance to previous hearing to State of Madhya Pradesh, through Principal Secretary, Department of Women and Child Welfare, Jabalpur Collector, Child Welfare Committee, Jabalpur and Arun Jain, Member, Child Welfare Committee and asked them to file their reply before the court.

It may be recalled that the division bench of MPHC on June 21, 2017, had issued notices to respondent authorities and asked them to file reply before the court, but the respondent did not submit compliance before the court, thereafter, on Friday, the division bench issued fresh notices to the respondent.  In previous hearing of the case, division bench had also directed Arun Jain that he shall not function as Member of Child Welfare Committee. Advocate Siddharth Gulatee has been appointed as Amicus Curiae to assist the court in the matter. Let notice be served upon the Child Welfare Committee and Arun Jain, returnable within three weeks.

Meantime, Arun Jain shall not function as Member of Child Welfare Committee, division bench said. The division bench has taken cognisance in letter petition and heard as a writ petition. The letter was sent by Member Secretary, Madhya Pradesh State Legal Services Authority (MPSLSA), Jabalpur, and mentioned that members of the Child Welfare Committee especially Member Arun Jain has misused membership of Child Welfare Committee, which is beyond rules. Madhya Pradesh State Legal Services Authority received several complaints regarding members of Child Welfare Committee to have sent notices to various small shops, restaurants, schools and asked explanation for use of children as a labour etc.

The division bench heard the petition against the Principal Secretary, Department of Women and Child Welfare, Collector Jabalpur, Child Welfare Committee, Jabalpur, Dr K Theophilus, Chairman, Child Welfare Committee, Arun Jain Member, Child Welfare Committee, Jabalpur, Neeta Gupta, Child Welfare Committee, Jabalpur and Shakuntala Poddar, Member, Child Welfare Committee.
