HC disposes of encroachment case

In the matter related to a petitioner, who is a lease holder of the land, where contractor Akhilesh Tiwari has illegally encroached the land of the petitioner and took out the stone (muram) and gravel (Gitti), the division bench of the Madhya Pradesh High Court comprising Justice, S K Seth and Justice, Anjuli Palo has directed the SDO, Niwas, District-Mandla to look into the matter and pass an appropriate order in accordance with law. Counsel for the petitioner shall submit a representation with necessary documents to the SDO, Niwas, District-Mandla within one week. Accordingly, present writ petition stands disposed off.


The bench has heard the petition filed by Shyama Bai from Mandla against the Collector, Jabalpur, Superintendent of Police, Mandla, SDO Niwas District Mandla and Mining Officer, Collectorate Mandla.


Petitioner is a lease holder of the land, where contractor Akhilesh Tiwari has illegally encroached the land of the petitioner and taken out stone and gravel (Gitti). Petitioner has approached the authority concerned for redressal of her grievances, but to no avail.


After hearing the parties, the division bench has disposed of this writ petition with aforementioned the direction to the SDO, Niwas, District-Mandla.
