Upholds bail to four dismissing SLPs by mother of deceased

Setting aside rejection of bail by a Single Judge Bench of the High Court, on October 12, 2015, Justice Rohinton Fali Nariman and Justice Sanjay Kishan Kaul at the Supreme Court have allowed two special leave petitions (SLP) filed by Ashok Ramlal Pawar and his brother Kuldeep, residents of Somnath Nagar in Washim district, and ordered their release on bail.

The apex court has also dismissed 4 special leave petitions filed by Nirmala Devidas Chavan, the mother of the deceased Avinash, against grant of bail to four other accused by another Single Judge Bench on January 19, 2017. Deceased Avinash succumbed to injuries received in assault by the accused persons constituting an unlawful assembly on March 18, 2014.
The accused persons are in jail since their arrest on March 19, 2014. More than 20 accused persons have been charged with sections relating to the offences of unlawful assembly, conspiracy, murder and attempt to murder.

The case is registered at Police Station Manora, for assaulting Devidas Chavan and his two sons, Mukesh and Avinash at Naik Nagar in Manora. After grant of bail to their brother Arun Ramlal Pawar by the apex court, the High Court Single Judge had granted bail to four persons on January 19 last. The mother of the deceased had filed SLPs for rejection of bail granted to these four accused persons by the High Court.
Advocates Sudheer Voditel and Rajendra Daga appeared for the accused persons.
