Decide petitioner’s representation within six weeks: HC to WRD incharge engineer

In the matter related to retired Assistant Engineer in Water Resources Department challenging the inaction on the part of respondents for not granting him arrears of Third Higher Time Scale Pay with interest, the Single Bench of the Madhya Pradesh High Court comprising Justice Subodh Abhyankar has directed to the Engineer In Chief, Water Resources Department (WRD), Bhopal to decide the petitioner’s representation within six weeks.


The petitioner before this Court is the Assistant Engineer (Retired), WRD Tulsi Nagar, Bhopal. The petitioner aggrieved by the inaction on the part of respondents in not granting him arrears of Third Higher Time Scale Pay with interest and
to make payment of revised pension after granting him benefit of third higher time scale pay and other consequential benefits. Though the petitioner has submitted a detailed representation dated on July 10, 2016 before the respondent Engineer In Chief, Water Resources Department, Bhopal in this behalf, but the same is still pending.


In the facts and circumstances of the case, this petition disposed off by the single bench with a direction to respondent Engineer In Chief, Water Resources Department, Bhopal to decide the petitioner's representation within a period of six weeks from the date of receipt of certified copy of this order. Accordingly, this petition stands disposed off.

The petitioner Shiv Kumar Gupta, Retired Assistant Engineer, Water Resources Department, Tulsi Nagar Bhopal filed petition against the Secretary, Water Resources Department, Bhopal, Engineer In Chief, Water Resources Department, Bhopal, Superintendent Engineer, Water Resource, Bhopal and District Treasury Officer, Directorate Of Treasury And Accounts, Bhopal. Advocate Satya Prakash Mishra appeared on behalf of the petitioner, while Piyush Jain, Panel Lawyer for the respondents, State.
