Notices seeking reply issued to concern officers in matter of encroachment

In the matter related to illegal encroachment on the government land kept reserved for construction of stadium in Village Ghunwara, Tehsil- Maihar, District Satna, the division bench of the Madhya Pradesh High Court comprising Chief Justice Hemant Gupta and Justice Atul Sreedharan on Monday, has issued notices to the Principal Secretary, Ministry of Panchayat and Rural Welfare, Bhopal, Collector Satan, Sub Divisional Officer, Maihar, District Satna, Tehsildar, Maihar, District Satna, Chief Executive Officer, Zila Panchayat Satna and Ram Kripal Khatik, Village Ghunwara, Tehsil Maihar, Satna and asked them to file their reply before the court. The division bench has listed the case after six weeks.

The petitioner filed this Public Interest Litigation (PIL) through Advocate Dharmendra Soni mentioned that the persisting encroachment over Khasra No. 97, Village Ghunwara, Tehsil Maihar, District Satna despite lawful orders of this Court in another PIL dated on August 14, 2006, order dated on November 26, 2014 in Reference Suo Moto Contempt Case is creating rider in construction of stadium in Village Ghunwara and despite representation to competent authority no action till date has been taken. Hence, the instant Public Interest Litigation is filed.

The petitioner prayed relief before the court to direct the respondents to take immediate action for removal of encroachment by respondent Ram Kripal Khatik over the piece of land meant for construction of stadium. The court may issue appropriate directions to the competent authorities/ respondents for ensuring the removal of encroachment in entirety which are subsisting over piece of land reserved for purpose of construction of stadium.
The petitioner prayed interim relief before the court that in the meanwhile, the status-quo with respect to property in question whose acquisition is proposed and the compensation is to be determined in lieu of acquisition be directed to be maintained by parties as it exists, in the ends of justice.
