Plea against power company disposed of, petitioners allowed to approach Labour Court

A SINGLE bench of Madhya Pradesh High Court comprising Justice J K Maheshwari has issued directions on petition filed by Kanhaiya Lal against Madhya Pradesh Poorva Kshetra Vidyut Vitran Company Limited being aggrieved by issuance of NIT by respondents to fill post of meter reader on regular basis on which the petitioners are working since last 10 to 15 years, this petition has been preferred by the petitioners. Single bench of MPHC disposed of the petition with directions that the petitioners can approach the Labour Court within a month.


The Labour Court shall consider and decide the claim of petitioners as per law within a period of one year.
Respondents may continue to carry out with process of appointment, but the petitioners shall not be discontinued without leave of this court. With aforesaid observation, the petition stands disposed of. Petitioners have filed copies of orders passed by this court in another writ petition (MP Poorva Kshetra Vidyut Meter Vachak Kalyan Sangh Tikamgarh (MP) vs Madhya Pradesh Poorva Kshetra Vidyut Vitran Company Limited) dated April 27, 2018, and other writ petitions. In those petitions orders have been passed relegating petitioners therein to approach Labour Court and in writ petitions directions have also been issued to continue petitioners in service.

In present case, similar directions have been sought for. After hearing counsel for the petitioner at length and considering orders passed by the court in writ petitions, this petition is disposed of with aforementioned directions.
