Stadium can be used for purposes of parking: HC

After hearing the review petition seeking permission to use the Wright Town Stadium for the purposes of parking beaches deployed on election duty, the division bench of the MPHC on Friday, said in order that “agreed to the request of ECI, held that order dated on December 2, 2015, do not refer to any blanket ban. Reasons of the Election Commission are genuine and bonafide therefore permission is granted. After one week of electoral process the ECI will handover it with original status back to the competent authority”.

The division bench of the Madhya Pradesh High Court comprising Chief Justice Hemant Gupta and Justice Vijay Kumar Shukla has heard the review petition filed by Election Commission of India through District Election Officer, District Collector against Satish Kumar Verma (He was petitioner in the public interest litigation which was ordered on December 2, 2015).

During the hearing, Collector Chhavi Bharadwaj appeared in-person before the court. Matter relates to the review of order passed in PIL whereby vide order, dated on December 2, 2015 passed in writ petition was filed by Satish Verma Versus District Collector Jabalpur.

Advocate Siddharth Seth Standing Counsel Election Commission of India on Friday, submitted before the court following facts that the Election Commission of India filed the review petition seeking permission to use the stadium for the purposes of parking beaches deployed on election duty. It was said elections to Vidhan Sabha can be notified anytime.  We have made MLB School as strong room centre. There are around 2200 polling both for 8 Vidhan Sabha constituencies in Jabalpur. Therefore all polling parties will include hundreds of election duty officers and employees. 

All EVM and VVPATs and other election material is taken from strong room centre MLB to polling booths and returned back. For this we have deployed around 500 buses and around 200 small vehicles in election duty.  Advocate Seth mentioned in the review petition that we have no other option but the Stadium. No damage will be caused. No sports activities are being affected. Stadium is already under renovation. Stadium is best suited in terms of law and order.

Even the order passed in 2015 was for prohibiting public rallies and political events and there cannot be Blanket Ban on the use of stadium.
