HC stays event management work tender of Indian Road Congress

Nagpur bench of Bombay High Court, on Thursday, granted stay to grant of event management work of Indian Road Congress (IRC) scheduled to be held at Mankapur Sports Complex from November 21 following a serious allegation of favouritism made by a bidder-company against the successful bidder-M/s Admaark Events Pvt Ltd. The timely objections about lack of eligibility were ignored and on the contrary the respondent-Public Works Department (PWD) favoured respondent company from the beginning, the petitioner firm claimed while raising question mark over decision making process to allot event management work of IRC to Admaark.

A division bench consisting of Justice Bhushan Dharmadhikari and Justice S M Modak, while hearing a petition filed by WE-the Working Elements, directed respondent-PWD not to allot work order to M/s Admaark Events Pvt Ltd or to any one else till November 19. The High Court, while issuing notices to respondent authorities and other bidders including Admaark, posted the next hearing on November 19 with a stern directive not to allot work order to anybody else. The respondent-Admaark is lowest bidder (L1) while petitioner is L2.

The petitioner claimed that respondents failed to upload the essential documents to determine eligibility during on-line process including those pertaining to past experience, human resources and other claims related to eligibility. When other bidders objected to this, a few documents without giving any opportunity to other bidders were attempted to be handed over by respondent-Admaark to PWD authorities during scrutiny, the petitioner claimed.

In fact, the tender scrutiny committee ignored lack of any experience of conducting IRC events and awarded seven marks to Admaark in the evaluation process, the petitioner claimed while asserting that respondent bidder should have been disqualified during the scrutiny, instead he was sought to be declared as responsive bidder and additional two marks were allotted to him to ensure the he gets the work of this prestigious event.
