Plea against encroachments to be heard after two weeks

IN THE matter related to removal of encroachments from Madan Mahal Hills and other hills, division bench of Madhya Pradesh High Court comprising Chief Justice Hemant Gupta and Justice Sushil Kumar Palo has listed the matter for next hearing after two weeks. Division bench of MPHC heard bunch of petitions filed by Kishori Lal Bhalavi and others.

In previous hearing of the matter, the counsel appearing for the respondent Corporation as well as the State prayed for and are granted permission to file a compliance and status report, after supplying a copy of the same to all. According to these reports, authorities are going ahead with removal of encroachments clearing of the area concerned and ensuring and preventing re-encroachment thereof.

It is undertaken by the counsel appearing for the State and Corporation that they will continue to do so and ensure that the orders passed by the court are implemented. Undertaking given by them before the court will be fully complied with as early as possible. It is stated that they shall make all efforts to see that encroachments are removed even before schedule or time sought by them at the earliest.

On objections being raised by some of the counsel for the petitioners regarding discriminatory manner in which the encroachment drive is proceeding, namely leaving out certain religious structures etc, the counsel appearing for the State as well as the Corporation submit that they shall take immediate and appropriate action in this regard and shall submit a compliance report in that respect by next hearing, division bench said in order in previous hearing. Advocate Balkishan Choudhary appeared on behalf of the petitioner, while Government Advocate Amit Seth for the State.
