Rape case: Appeal challenging order passed by single bench of MPHC dismissed

In the matter related to rape case, the division bench of the Madhya Pradesh High Court comprising of Chief Justice, Hemant Gupta and Justice, Vijay Kumar Shukla has dismissed the writ appeal challenging the order passed by single bench of the MPHC. The division bench has said that "we do not find that any intervention in the matter is dismissed."

The division bench has heard the writ appeal filed by Jaishree Soni against the State Government. Challenge in the present appeal is to an order passed by single bench on March 26, on writ petition, whereby the petitioner/appellant has sought writ of mandamus to arrest the accused persons for the alleged offences punishable under Sections 342, 376(2)(n), 323 and 506 IPC.

As per the investigation carried out, the allegations of the petitioner have not been corroborated. Such aspect has been examined by Single Judge and liberty has been given to the appellant to raise all objections before the court of competent jurisdiction where the closure report is filed.
