HC disposes of plea seeking 3rd Kramonnati payscale

A single bench of the Madhya Pradesh High Court comprising Justice, Vandana Kasrekar has disposed off the petition seeking benefit of 3rd Kramonnati payscale and directed to the respondents to consider the case of the petitioners for grant of IIIrd Kramonnati in light of the circular dated on October 25, 2017 passed by the State Government and, if the petitioners are found fit, then the same benefit be extended to them within a period of three months. It is made clear that this court has not expressed any opinion on the merits of the case. With the aforesaid observations, the writ petition stands disposed off, with no order as to costs. The single bench of the MPHC has heard the petition filed by Bhushan Prasad Sahu and others.

The petitioners have filed the present petition praying for benefit of IIIrd Kramonnati Pay Scale. Petitioners were initially appointed as a ‘Trainee’ and joined on October 10, 1973 and July 12, 1976 respectively. After completion of the training, they have been appointed on the post of Assistant Teacher. Counsel for the petitioners submitted that the petitioners have already completed more than 30 years of service and petitioner No. 1 retired on December 31, 2014 and petitioner No. 2 retired on October 31, 2017. In the meanwhile, the State Government has issued a circular dated on October 25, 2017 thereby extending the benefit of IIIrd Kramonnati to the teachers from July 1, 2014.

He further submits that as the case of the petitioners is fully covered by the said circular, therefore, the petition filed by the petitioners may be disposed of with a direction to the respondents to consider their case in light of the circular issued by the State Government on October 25, 2017.
Government Advocate appearing on behalf of the respondents, State submits that necessary action will be taken in the matter. In view of the aforesaid submissions made by learned counsel for the parties, the petition filed by the petitioners is disposed of with aforementioned directions.
