HC bench asks striking Gram Rozgar Sahayaks to join duty immediately

In the matter challenging the strike of Gram Rozgar Sahayaks of the State, the division bench of the Madhya Pradesh High Court comprising Justice, S K Gangele and Justice, Subodh Abhyankar has issued order that the Gram Rozgar Sahayaks shall forthwith resume their duties and they shall not proceed on strike. They shall attend their duties positively within a period of three days, failing which, the Chief Secretary is at liberty to take appropriate action against the concerned Gram Rozgar Sahayaks. It is further ordered that the State shall also file its reply within two weeks as undertaken by the counsel appearing on behalf of the State in regard to the demands of the Gram Rozgar Sahayaks. The division bench of the MPHC has listed the case after two weeks for next hearing.


The division bench has heard the petition filed by Brajesh Patel. The division bench has also issued notices to the respondent authority returnable within four weeks. The petitioner submitted in the petition that the Gram Rozgar Sahayaks are on strike for last 25 days and due to aforesaid strike, various works performed by the Gram panchayats under the MGNREGA have been affected. The persons are not getting salary. The duties assigned to the Gram Rozgar Sahayaks have been mentioned in the documents. Hence, strike of the Gram Rozgar Sahayaks is illegal.


Due to the strike of Gram Rozgar Sahayaks, work of Gram panchayats has been paralysed and the State is not able to give benefit to the poor persons. In similar circumstances, this court has passed interim orders in another writ petition. Counsel for the State has submitted that due to the strike of Gram Rozgar Sahayaks, work in the State is suffering badly. The Gram panchayats are not able to perform their statutory duties assigned to them under Article 243 of the Constitution. He has further submitted that the Government is willing to consider reasonable demands of Gram Rozgar Sahayaks in accordance with law. In view of the above facts, the division bench has issued aforementioned directions.
