CGHB fined for delay in giving possession of flat

The District Consumer Forum on Friday fined Chhattisgarh Housing Board (CGHB)for delay in giving possession of the flat to a buyer. The Consumer Forum directed its Executive Engineer at Padmanabhpur to pay Rs 5.34 lakh compensation to the victim buyer with Rs 10,000 excess as litigation cost. The victim Ranjeet Kumar Singh (45 years) is a resident of Quarter-2/H, Street-86, Sector-6, Bhilai. 

In his complaint, the victim had alleged that on June 1, 2011 he deposited Rs 2.05 lakh with the CGHB for purchasing a house at Vishwa Bank Colony, Kurud, Bhilai. Later on July 11, the CGHB allotted him MIG – 1/1592 and by obtaining a loan from HDFC Bank, he deposited Rs 8.19 lakh in different installments. The victim in his complaint alleged that the CGHB failed to give possession of the flat consequently which he was forced to pay Rs 5,000 monthly rent for accommodation. He then asked the CGHB to refund Rs 8.19 lakh deposited in installments through bank loan and the CGHB refunded the amount.

Meanwhile, the CGHB in its reply to the Consumer Forum stated that no time limit was given to the victim for giving possession of the flat and he was never told when he will be handed over the house. The Consumer Forum directed the CGHB to pay Rs 1.20 lakh expenses paid by victim as rent from 2013 to 2016, Rs 2.05 lakh interest on bank loan and Rs 2 lakh for mentally harassing the victim.
