Notices to respondents in allotment of shops case

In the matter related to allotment of the shops at Fish Market situated at Bhagat Singh Ward, Seoni, the single bench of the Madhya Pradesh High Court comprising Justice, Vijay Kumar Shukla has issued notices to the respondents Principal Secretary, Urban Administration Department, Bhopal, Collector, Seoni, Chief Municipal Officer, Nagar Palika Parishad Seoni and Deputy Director, Fisheries Department, Seoni and asked them to file their reply before the court within four weeks. The single bench also directed that till the next date of hearing, though proceedings pursuant to the modified impugned auction notice, dated on August 30, 2018 will go on, but allotment orders will not be issued.


The single bench of the MPHC has heard the petition filed by Mohammad Firoz Khan and others. Advocate Dinesh Upadhyay, Counsel for the petitioners, submitted that earlier, auction notice was issued by the Municipal Council, Seoni, inviting offers for allotment of the shops at Fish Market situated at Bhagat Singh Ward No.23, Seoni. Tenders of the petitioners have been cancelled by order dated on August 30, 2018 and on the same day,a tender notice has been issued. Now, the offer has been confined only to the persons belonging to the Machhuara community.

It is strenuously urged by him that such condition was not prescribed by the Municipal Council and the tender has been cancelled, only pursuant to the decision taken by the Collector, Seoni in his meeting dated 13-8-2018 and the order issued by the Deputy Director, Fisheries, Seoni dated on August 16, 2018. It is further submitted by him that the petitioners are engaged in the sale of fish for the last many years. Considering the aforesaid submissions, issue notice to the respondents, returnable within a period of four weeks. The single bench of the MPHC has listed the case after four weeks.

As an ad interim measure, it is directed that till the next date of hearing, though proceedings in pursuant to the modified impugned auction notice, dated on August 30, 2018 will go on, but allotment orders will not be issued, the single bench said. Advocate Dinesh Upadhyay appeared on behalf of the petitioners, while Government Advocate Aditya Jain for respondents.
