High Court dismisses 3 old petitions, imposes costs on ‘disinterested’ litigants

Justice Sunil B Shukre and Justice Rohit B Deo have dismissed three 13-year-old petitions for ‘want of prosecution’, thereby setting example for other similarly disinterested petitioners and their lawyers, who are not interested in prosecuting their writ petitions and consistently remain absent when their cases are posted before the High Court here.
The court has also imposed costs of Rs 10,000/- on each of the petitioners -- Nathu Gangadhar Rambhad, Proprietor of Power Controls; Suman Vishwambharrao Vadafale and Others; and Kamsalkishor Tulsidasji Malpani (Pulgaon) -- and directed them to deposit the amount of costs in two months at the Government Pleader’s Office at the High Court, Nagpur for development of its Library.
The court has noted in its separate orders that the petitioners have remained absent consistently over a long period of time.
Though the court has granted too much of accommodation to them, they have shown no inclination to appear before the court to argue the cases. It is obvious that they are not interested in prosecuting these petitions. In the event of the failure of the petitioners to pay the costs imposed on them, the court has directed the Registry to intimate to the Collector to recover these amounts as arrears of land revenue.
