PCR of another accused Girish Dasarwar extended till September 2
JUDICIAL Magistrate First Class (JMFC) S D Mehta on Wednesday remanded Mickey alias Rupinder Bakshi, prime accused in the sensational Rishi Khosla murder case, to magisterial custody (MCR) and extended the police custody remand (PCR) of another accused Girish alias Nanu Dasarwar till September 2. Four other accused -- Rahul alias Baban Raju Kalamkar, Kunal alias Chayana Suresh Hemne, Arif Inayat Khan and Aziz Ahmed alias Pangya Anees Ahmed -- are already in the custody of Sadar Police till September 2.
Senior Inspector (Sadar) Mahesh Bansode produced accused Mickey Bakshi and Girish, facing charges under Sections 302 and 34 of the Indian Penal Code, before JMFC Mehta. Seeking extension of PCR of Bakshi and Dasarwar till September 2, the prosecution told the court that further interrogation of the accused duo was necessary to unravel the truth in the case. Appearing for accused Bakshi, Adv Prakash Naidu argued that his client was falsely implicated in the matter and had absolutely no role in the crime. Negating allegations of the prosecution that it was a case of contract killing and accused Mickey Bakshi had given ‘Supari’ to other accused to eliminate Rishi Khosla, Adv Naidu argued that the police should first demonstrate the criminal intention of his client before levelling such serious allegations against him. The prosecution had not pointed out about the motive behind the murder which in their application for PCR was bodaciously lacking, he added.
Adv Naidu argued that the police machinery in the absence of any nexus, mens rea, motive, and criminal intention, cannot proceed to mechanically seek extension his client’s PCR. The defence lawyer emphasised strongly on the aspect that the mitigating and incriminating chain between the alleged killers and accused Mickey Bakshi had to be demonstrated by the police machinery by producing substantial and concrete evidence and statements of eye witnesses. Rebutting the contentions of the prosecution, Adv Naidu pointed out that matrimonial litigations with regards to the custody of the son, divorce and maintenance was pending inter se between accused Mickey Bakshi and his wife since last year.
He also also argued the proprietary of the wife of his client to name Mickey in the commission of the murder itself cast under a grave cloud of doubt. She and his client had separated almost two years ago. The prosecution told the court that police intended to confront all accused and interrogate simultaneously to bring out the truth. After hearing the grounds cited by the prosecution and arguments of the defence, the court remanded accused Mickey Bakshi to magisterial custody and extended PCR of accused Girish Dasarwar till September 2. Adv Naidu was assisted by Adv Pankaj Thakre, Adv Homesh Chauhan, Adv Rahul Rathe, Adv Surabhi Godbole, and Adv Mitesh Bais. Adv Chetan Thakur represented Dasarwar.
