MIA suggests industrial plot holders to follow MIDC rules

As per the latest circular issued by Maharashtra Industrial Development Corporation (MIDC) head office at Mumbai, it will soon start implementing a ‘Special Scheme’ for action to be taken in case of sub-lease for industrial purposes without NoC across the State’s industrial areas, as informed by MIDC Industries Association (MIA) Hingna. In the industrial areas of the MIDC, the sub-lease is levied on the area leased by the entrepreneurs on their land at the prevailing rate of that year depending on the industrial or commercial use.
 
However, as the prevailing sub-lease charges are high, the majority of plot holders in an unauthorised way lease out areas of the building without the prior permission of the MIDC or the plot holders do not use the plots as per the prevailing policy of the MIDC. It has been discussed that in addition to levying sub-lease charges and penalties as per the rules, interest should also be levied on the leased area without a no objection certificate (NoC). Therefore, the proposal for implementation of special scheme for recovery in this case was presented in the 389th meeting of the Board of Directors dated April 29, 2021 and the matter was discussed in detail and resolution number 6262 was passed. As per the resolution passed, the details of the ‘Special Scheme’ that will be implemented are as follows:- 1. For the leased area, 50 per cent rebate should be given on the amount of interest and penalty charges on the lease levied as per the policy of that time.
 
2. The scheme presented shall be applicable on industrial plots only for industrial use in sub-leased areas without no objection certificate. 3. For those plot holders who do not avail the benefit of the above scheme, a special campaign should be launched and all the dues should be recovered and action should be taken to take possession of the plot as per the agreement. 4. Plot holders who have already paid the amount of sub-lease penalty and interest thereon will not be eligible to avail the benefit of this scheme or the amount paid by them will not be refunded or adjusted. 5. The submitted scheme will be applicable only till December 31, 2021, informs a press release issued by C G Shegaonkar, President of MIDC Industries Association Hingna.
