In an interactive meeting with Nitin Patil, Special Commissioner of State Tax, Department of Goods & Services Tax, Mumbai, members of the Vidarbha Industries Association (VIA) Taxation & Corporate Law Forum raised the demand of Customs, Excise and Service Tax Appellate Tribunal (CESTAT) in Nagpur. The members said that to clear the pending cases of a large number of taxpayers, authorities should set up a CESTAT office especially for the Vidarbha region. At present, the taxpayers have to visit the Mumbai office of CESTAT for appeal. CA Ashok Chandak, Chairman - VIA Taxation & Corporate Law Forum, also raised the issues pertaining to GST / BST Act, MVAT Act/CST Act and submitted a detailed representation to Nitin Patil, Special Commissioner of State Tax, Department of Goods & Services Tax, Mumbai. It is important to note that the GST Council has already approved the proposal of setting up CESTAT office in Nagpur but nothing has been done in this regard.

 

CA Ashok Chandak further said that refund of accumulated GST on account of purchase of capital goods should be allowed to claim for a business having inverted duty structure. Further, the forum sought clarity on GST on water charges. It was discussed that water is exempt from tax, therefore supply of water by any entity including Government entity is exempt from tax, necessary clarification be issued so that agencies like MIDC should not demand GST. Nitin Patil assured that he will take up the matter with the concerned department and give priority to resolve the non-technical issues as well as technical issues by consulting with the technical people.

 

On the occasion, Vilas Padvi, Deputy Commissioner of State GST (Investigation) was also present. CA Saket Bagdia, Past Chairman of Nagpur Branch of WIRC of ICAI made an opening remark and briefed about the purpose of conveying this important meeting.
