Ajni Police have registered an First Information Report (FIR) against Dean of Government Medical College and Hospital (GMCH) and 10 other doctors for medical negligence. The case of 2019 involves 11 doctors who had performed operation upon a woman patient who died during the course of treatment. The relatives of the deceased woman had alleged that she died due to doctors’ negligence. As the police did not take any cognisance, the family approached the court. On the instructions of the court, a case has been registered against 11 doctors, including present Dean of the GMCH, Dr Raj Gajbhiye, who was then Head of the Department of Surgery at GMCH. The others who were named in the FIR are - Dr Bhupesh Tirpude, Dr Hemant Bhanarkar, Dr Wasudev Barsagde, Dr Apurva Anand, Dr Sushmita Sumer, Dr Vikrant Akulwar, Dr Gayatri Deshpande, Dr Girish Kodape, Dr Vidheya Tirpude and Dr Ganesh Kharkate. Retired Superintendent of District Court, Kevalram Pandurang Patole (65), is the complainant.
 
Patole’s wife Pushpa had developed a lump on her neck. During treatment at GMCH, she was to undergo surgery posted on July 5, 2019. But the surgery was performed on July 6, 2019. During the surgery, her condition deteriorated. Cotton gauze were placed over her eyes, and a hose was attached to her nose. After the surgery, she was shifted to the ICU. None of the relatives was allowed to see her, alleged her kin. They pointed out that Dr Gajbhiye also refused to move her to another hospital. On July 8, 2019, when Patole sought her discharge on advice of a familiar doctor, he was told that his wife had died in the night. Suspecting negligence at the hospital, Patole approached Ajni Police. He complained to the police that his wife Pushpa underwent surgery at GMCH on July 5, 2019, but died 3 days later.
 
Police, initially, did not lodge the complaint. But on June 30, 2020, a formal complaint was recorded by the police regarding the medical negligence. On this, a five-member committee was formed to probe the issue. The committee recorded statements of the doctors involved. The committee was told that the patient had died due to cardiac arrest.
Not satisfied with the report of the committee, Patole approached Medical Education Ministry that had constituted the committee. Later, the committee examined all the documents and concluded that there could be negligence before the patient was operated upon. Not buying the committee’s verdict, Patole again approached Ajni Police and filed a complaint on April 15, 2022.
 
Unable to get response from the police, Patole moved the court on May 2. Additional Chief Judicial Magistrate, on going through the details, allowed him to file the case. Accordingly, Ajni Police registered offences under Sections 201, 202, 301 (A) and 34 of the Indian Penal Code against the 11 doctors involved. When ‘The Hitavada’ contacted Dr Raj Gajbhiye, he told, “There was no negligence. We took all care of the patient. She suffered cardiac arrest during the operation. In some cases, such medical conditions do take place. We were constantly in touch with the relatives of the patient and kept counselling them. After death of the patient, we kept the option of Post Mortem open but her relatives opposed. We have a letter bearing their signatures. We tried our best to save the patient but could not.”
