What began as a disagreement over wedding attire spiraled into a legal confrontation resulting into registraton of an First Information Report (FIR) with the charges of rape and dowry demand. The Nagpur Bench of the Bombay High Court meticulously examined the criminal application and ordered quashing of the charge-sheet arising from the FIR. The dispute centers around the applicant, Shubham, and non-applicant woman, whose relationship soured over disagreements regarding wedding arrangements which ultimately led to their marriage plans cancelled. The woman lodged a report on April 21, 2023, which led to the registration of a crime at Dhantoli Police Station. Employeed in the HR Department of a Pune-based company, she is currently working from home. Shubham became her Facebook friend in November 2021. They were also close relatives, so their friendship evolved into a love affair. The woman resides in Nagpur and works from home, while Shubham resides in Chandrapur and works as a clerk in the Tahsil office in Rajura, District Chandrapur. The allegations state that when Shubham came to Nagpur to meet her in January 2022, he established a physical relationship with her under the pretext of marriage. Thereafter, he continued the sexual relations with her. Both of them informed their family members about their love relationship, and their families accepted it. Later, they got engaged on November 5, 2022, and the marriage was fixed for May 11, 2023. They celebrated the engagement by exchanging clothes, and started gearing up for the marriage ceremony.
During discussions about wedding attire, a dispute arose between Shubham and the woman. After involvement from both families, a meeting was held to resolve the issue. Allegedly, during this meeting, Shubham’s mother and sisters demanded a heavier gold chain and a car for Shubham as part of the marriage arrangements. The discussions took place over a conference call, followed by a physical meeting where tensions escalated, leading to verbal abuse and physical assault. Consequently, the marriage between Shubham and the woman was called off. Following the altercation, Shubham attempted to lodge a complaint at the police station over alleged abusive language and assault. However, considering their close relationship, the police mediated and advised against filing a complaint, and they returned home.
Upon learning of this, the woman filed a report against Shubham and his family members which resulted in the registration of a crime. However, in a recent development, the Bombay High Court intervened in the case and ruled that the sexual relations between Shubham and the woman were consensual and that the allegations of false promises of marriage were unfounded. Additionally, the court found no evidence to support the charges of dowry demands and assault against the other applicants. The division bench of Justice Vinay Joshi and Justice Vrushali Joshi quashed the charges against all the applicants and bring an end to the legal battle that ensued from a dispute over wedding attire.
